DA says Atlanta Highway shooting suspect’s bail was too low - WSFA

MONTGOMERY, Ala. (WSFA) - An arrest has been made more than a month after the shooting of Montgomery native Amy Dicks.

Dicks, an innocent bystander, was paralyzed after she was shot while sitting in her car at busy Montgomery intersection.

Michael Johnson, 20, has been charged with assault and discharging a gun into an occupied vehicle. He made his bail of $90,000 Monday morning.

Montgomery County District Attorney Daryl Bailey says bail was set too low.

“Any case like this where there’s a shooting, there’s a homicide, where there’s a shooting of a person who’s seriously injured, your bail should be so high for those two things: public safety and to send a message.” said Bailey.

Johnson is now free to live and work within the community as he pleases.

Bailey says he and his office met with the Montgomery Police Department before the suspect was charged.

“We look at the law, and we look at what we’re able to prove with the evidence that they have at the time, and we advise law enforcement on what we believe are proper charges that we can prove in the court of law.” said Bailey.

Bailey says MPD did not take his advice. He says there were additional charges that could have been filed.

Bailey also blames legislation.

“‘Anaiah’s Law’ is a great law. It’s there to protect our community. But when attempted murder and assault one are not included, that’s a problem,” said Bailey.

MPD sent a statement on the case saying, “Following a thorough review of the evidence, the Montgomery Police Department has pressed the appropriate charges in the case of Amy Dicks. This case will be turned over to the District Attorney’s Office and brought before the grand jury who will charge or not charge. Based on the recommendations of the District Attorney, the grand jury can also upgrade charges based on the evidence. The Montgomery Police Department will remain consistent in pursuing appropriate charges without bias or prejudice.”

While justice has yet to be served, both Bailey and Montgomery County Commissioner Doug Singleton say they are proud of the community coming forward to help make Montgomery a safer place.
